Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from elevations while climbing up the side of a scissors lift elevated over 30 feet, and onto the steel beam above. Among other methods, feasible abatement methods include: (1) Move the scissors lift to the area where the work is to be performed, turn the lift sideways to allow it to fit between the barjoists, then elevate to the top of steel. (2) Install scaffold stairway to top of steel. (3) Implement a program to ensure that employees are aware of the proper methods to operate this type of equipment i.e. the Operators Manual and ANSI/SIA A92.6-1990.
