P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck in the event of crane overturning, structural failure, or collapse due to wind force on loads with large surface areas: a)Brunswick River between columns 8N and 7N - The lift was not aborted and the load was not safely landed back at the material barge or other safe area when wind conditions first became apparent while employees were using a 125-ton model 9260 American crawler crane serial number GS15794 on a 40'x110'x7' crane barge (number KS-405) to move a metal form, that was in the shape of an "L" and was approximately 16' high by 20' long on one side and 12' long on the other side, from a material barge to bridge column 8N, on or about 4/1/97. Among other methods, one feasible and acceptable abatement method to correct this hazard is to use smaller sections of form to assemble-in-place on the columns and make picks when wind conditions allow tag lines to control the load.

P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of crane, barge, and related equipment failure, degrading, and unseaworthiness: a)Brunswick River - The periodic annual inspections for the 125-ton Model 9260 American crawler crane, the 100-ton model 7260 American crawler crane, and the 150-ton model 9270 American crawler crane did not include items relating to the barges, such as inspection of tiedowns for wear, corrosion, and tightness; or barge cleats, bitts, roller chocks, capstans, ladders, and stanchions for corrosion, wear, deterioration and deformation, the rescue skiff, life lines, work vests, life preservers, and ring buoys for deterioration and unseaworthiness, on or about 4/1/97. Among other methods, one feasible and acceptable abatement method to correct this hazard is to conduct these inspections in accordance with the criteria for periodic inspections as specified in ANSI B30.8 Floating Cranes And Floating Derricks including barge mounted land cranes.
