Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of drowning in the event of a catastrophic
failure of the graving
dock's floating caisson gate.
a.Employees engaged in ship repair operations were working inside of the
graving
dock located at Pier #15, Old Navy Pier, San Juan, PR.
Among others, feasible and acceptable abatement methods to correct these
conditions are
to:
1.Develop and implement an plan for the caisson gate's rehabilitation and
operation so as to develop a ship repair/maintenance facility.
2.Develop an extensive survey to determine whether it is safe to repair or
replace the graving dock's floating caisson gate.
NOTE:Certification and documentation of abatement must be submitted for
this citation
item as required by 29 CFR 1903.19.
