Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falls from aerial lifts:
a)  Colorado Construction Cleaning operated the Denka Lift at Park Meadows
Mall with three
of the four required outriggers extended, and with support blocking under
the frame of the
Denka Lift in place of the fourth outrigger.  On August 22, 1996 an
accident occurred as the
result of the lift becoming unbalanced, and one employee sustained serious
injuries when the
Denka Lift tipped over.
b)  Colorado Construction Cleaning operated the Denka Lift at Park Meadows
Mall with the
outrigger limit switch control system bypassed, in order to allow the lift
to operate with less than
four outriggers extended.  On August 22, 1996 an accident occurred as the
result
of the lift
becoming unbalanced, and one employee sustained serious injuries when the
Denka Lift tipped
over.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to follow the manufacturer's requirements regarding the limit switches and
outriggers.s
