General-duty citation text

NYSLL Article 2, Section 27a(3)(a)(1):  The employer did not furnish to
each of its
employees, employment and a place of employment which was free from
recognized hazards
that are causing or likely to cause death or serious physical harm to its
employees and which
will provide reasonable and adequate protection to the lives, safety or
health of its
employees.  In applying this paragraph, fundamental distinctions between
private and public
sector employment have been recognized.  (a) Guilderland Town EMS Dept. -
Paramedics
were exposed to the hazard of being infected with Mycobacterium
tuberculosis through
repeated, prolonged, indoor contact with patients who may be infected with
tuberculosis in
that no medical screening was offered.  Paramedics ride in enclosed
ambulances with the
patients.  Reasonable and adequate abatement methods for reducing this
hazard include, but
are not limited to, offering annual Mantoux skin tests as recommended by
the Centers for
Disease Control.
