Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by a falling load:
a)North edge of West Lake, Riverboat shipbuilding site; the rated load
capacity was
not marked on a two leg wire rope/spreader bar assembly, nor was there
documentation at the site as to its safe working load capacity.  The
spreader bar
assembly was suspended from the Link Belt crawler crane, it had welded lugs
attaching the wire rope connection points to the spreader bar, and was
used to lift
loads of steel weighting up to 10,000 pounds.
Recommended Abatement:
While ultimate responsibility for correcting the hazards rests with the
employer given his
superior knowledge of the operation, one feasible, and acceptable method
to
be taken by
the employer to correct this hazard would be to have a registered
professional engineer
determine the safe working load capacity for this spreader bar assembly,
and then to
mark the spreader bar assembly with that rating.
