North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Struck by hazards a)Jobsite - Employee permitted to and observed by management operating a skid steer loader from which the protective side screens had been removed by the employee, which resulted in a work related fatality on 07-06-97. A reasonable and feasible means of abatement would be for the employer to prohibit the "practice" of operating the loader with the factory installed safety screens removed. North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Struck by hazards a)Jobsite - Employer did not conduct an adequate pre- operational inspection of equipment provided to employee for functional defects and servicability of the left pivot pin which resulted in a work related fatality on 07-06-97. A reasonable and feasible means of abatement would be for the employer to assure that a proper and complete pre-operational servicability inspection of employer provided machinery was conducted to detect conditions which would render the machinery unservicable. This resulted in a work related fatality on 07-06-97. A reasonable and feasible means of abatement would be for the employer to train the employee that the "practice" of operating the loader with the factory installed safety screens removed was both prohibited and a recognizable hazard.
