and Health Act of North Carolina:  The employer did not furnish to
each of his employees  condition of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to

management operating a skid steer loader from which the
protective side screens had been removed by the employee,

A reasonable and feasible means of abatement would be for the
employer to prohibit the "practice" of operating the loader with
the factory installed safety screens removed.
