North Carolina General Statute 95-129 (1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)lineman's truck, employer failed to remove from service the lineman's truck which had a damaged personnel carrier,(bucket). ANSI/SIA A92.2 1990 8.2.4.15(e):Any suspected items shall be carefully examined and a determination made by a qualified person as to whether they constitute a safety hazard. All unsafe items shall be replaced or repaired before use.re
