North Carolina General Statue 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  condition of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to: use of forklift for
purposes not allowed by the manufacturer.
a)84 Lumber Company site, storage yard, open sheds  -
employees used a HYSTER forklift, SN: D177D36611U, Model:
H50XM, to support pallets used as platforms to repair
rafters of sheds. Platform was elevated approximately 11
feet above hard packed earth and was not provided with
guardrails . Operator's manual on page #40 (operating
procedures) prohibited the use of forklift to support
platforms. No other  means of fall protection were
provided.
Reference: HYSTER H50XM Operator's Manual, page 40. Operating
Procedures: "...keep yourself and all other clear of the lift
mechanism. Never allow anyone under or on top of the forks...".
Feasible means of abatements for this hazard may include but is not
limited to: the proper use and erection of scaffolds, aerial lift
devices, fall arrest systems with anchoring points on steel
structure of the sheds and safety net systems.
