Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being caught in the underside of
the conveyor belt:
(a)Meadow Gold Dairies, Inc. at 450 25th Street, Greeley, CO 80631:  On or
before 06-04-98, the employer did not ensure that the underside of the
moving
conveyor belt, 6' 4" above a walkway was guarded by location or a "pan
guard" for the old sterile track conveyor in the processing area near the
headend on the South side.  Condition exposed employees to a caught in
between hazard.
(b)Cooler #1:  The employer did not ensure that the underside of the moving
conveyor belt, 6' 8" above a walkway was guarded by location or a "pan
guard" for the old sterile track conveyor throughout the conveyor system.
Condition exposed employees to a caught in between hazard.
(c)Wire Room:  The employer did not ensure that the underside of the moving
conveyor, 6' 6" above a walkway was guarded by location or a "pan guard"
for the juice conveyor near the exit.  Condition exposed employees to a
caught
in between hazard.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to perform the following:
ASME B20.1-1996, The American Society of Mechanical Engineers--An American
National
Standard--Safety Standard for Conveyors and Related Equipment, paragraph
5.9.2(c)
Guarding by Location or Position:  "When a conveyor passes over a walkway,
roadway, or
work station, it is considered guarded by location if all moving parts are
at least 2.44 m (8
ft) above the floor or walking surface or are otherwise located so that
personnel cannot
inadvertently come in contact with hazardous moving parts."
