Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees operated forklift without personal restraint device (seat belt).
(a)Philcraft Homes Inc., at 8080 Smith Rd. Denver, CO.  On or before 10-27-
98, the ensure that the Hyster forklift, Serial No C5D12390S was equipped
with operator's seat belt for the prevention of an accident or injury from
a
forklift overturn hazard.
Among other methods, one feasible and acceptable abatement method to
correct the
hazard is to ensure proper training and enforcement is provided to all
forklift
operators regarding the required use of personal restraint devices per
national
consensus standard ASME B56.1-1993 - Safety Standard for Low Lift and High
Lift Trucks.
Abatement Note:  Abatement certification is required for this item (see
enclosed "Sample
Abatement-Certification Letter").
Abatement Note:  Warning tag (or citation copy) may be required for this
item (see enclosed
1903.19; paragraph (i) Movable Equipment).
