Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a) The hazard of being struck by a trash truck, in that, on or about
10-17-98, trash truck
#12 was being backed down a one-way alley, with the backup warning device
disabled and
struck an employee of another company, catching him between his truck and
the trash truck,
fatally injuring him. One feasible method to correct this hazard, would be
to ensure external
warning signal device conforming to ANSI/SAE J994b, type be actuated when
the vehicle is
operating in reverse; ensure employee(s) are trained and use panic button
or energy alarm to stop
vehicle movement.s)
