North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to tip over hazards as a result of operating an aerial lift on uneven terrain: (Reference ANSI/SIA A92.2- 1990, Section 8.13.2!: a)site-employees were working on the platform of a Genie Extensible Boom platform lift at fall heights of 28', painting the eaves of a building, with the lift parked on a 9.5-10 degree incline. The equipment manufacturer requires the equipment be operated at a slope of no greater than 4.5 degrees. (ref ANSI/SIA A92.2-1990 Section 8.13.2 and page 2 of the operator's manual). One possible means of abatement is to insure that the aerial lift be used only within the manufacturers allowable operating parameters at a slope no greater than that recommended by the manufacturer of 4.5 degrees.
