KRS: 338.031(1)(a):  The employer did not furnish employment and a place
of employment
which were free from recognized hazards that were causing or likely to
cause death or
serious physical harm to employees:
a.For the employee(s) who were required to take temperature readings on
the cat
walks which were positioned over the Carbon Bake Furnaces.  On August 20
1999, at approximately 8:35am an explosion occurred.  And again on August
31, 1999, a second explosion occurred in sections 6-9.  The employees were
allowed after the second explosion on August 31, 1999 to go onto the cat
walks for the purpose to take temperature readings as well as other
measurements.
