NYSLL Article 2, Section 27-a.3.a(1): The employer did not furnish to each of it's employees, employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to it's employees and which will provide reasonable and adequate protection to the lives, safety or health of it's employees. In applying this paragraph, fundamental distinctions between private and public employment has been recognized. (a)Employees (Health Care workers, Corrections Officers, and others who come in contact with the high-risk population) were exposed to the hazard of being infected with Mycobacterium tuberculosis through repeated, prolonged, indoor contact with inmates who were potentially infectious or suspected of being infectious with TB in that the TB Isolation Rooms (# 1237, 1238) were not maintained under negative pressure in relation to the corridor and anterooms; PPD conversions were not investigated; and one conversion was not recorded on the DOSH 900 for calendar year 1998. Reasonable and adequate abatement methods, as recommended by CDC, which may be implemented to abate the hazard, include but are not limited to: (1)TB skin testing shall be conducted at least annually for facility employees. (2)Isolation and treatment rooms in use by individuals with suspected or confirmed infectious TB disease shall be kept under negative pressure to induce airflow into the room from all surrounding areas such as ante- rooms, corridors, plumbing chases, etc. Airflow testing must be conducted and recorded at least semi-annually, although a quarterly schedule is preferred by most health care facilities. (3)PPD conversions must be investigated in accordance with CDC MMWR 10/28/94/Vol. 43/No. RR-13 Pg 41-57, and appropriate public health agencies must be notified. (4)PPD conversions must be recorded on the Form DOSH 900 (Occupational Injuries and Illnesses Report). One employee converted in the last calendar year.dar
