Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of falling off of the front bucket of a track loader as it raised and lowered him. (a)On 7/13/99, in the processing area, CSHO observed an employee being raised and lowered on the bucket of the 1984 Caterpillar 973 Track Loader (serial 32Z00638). The employee was being raised to heights of approximately 20-25 feet in order to lube wall fans. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD ARE: 1) Prohibit employees from riding the bucket at any time for any reason. 2) Follow the Caterpillar 973 Track-Type Loader operation manual, page 5 states; "Do not allow riders on machine unless additional seat, seat belt and roll- over protection are provided." 3) Follow the CIMA (Construction Industry Manufacturers Association) safety manual for Crawler, Tractor/Loader which states "Never use a bucket or blade for a work platform or personnel carrier." ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED FOR THIS ITEM.
