Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Moving equipment and vehicles while working on a scissor lift in the roadway of a shopping center which was not barricaded, flagged or roped off for the employees protection. a)Lakeview Plaza Shopping Center - Employee using a JLG scissor lift, Model CM 2033, S/N 020011487, was exposed to vehicular traffic while installing tyvex on the exterior of the building. The addition of vehicular traffic in the work area of the lift increased the potential for an accident because the employee/operator had to move the lift while holding tyvex sheets, watch traffic and steer the lift in a straight direction inches from the curbing. Feasible abatement methods include: (1) Ensure that employees barricade and block off areas where scissor lifts are to be operated as per ANSI A92.6-1990, 7.11.2. (2) Implement a training program to ensure that employees are aware of the proper methods to be used to operate scissor lifts such as those described in the Operators Manual and ANSI/SIA A92.6-1990.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Operational and driving hazards created by modifications made to the JLG scissor lift, Model 2033, S/N 020011487, with the attachment of a 11 foot tall wooden towel paper holder type device which was fastened to the outside of the railing system by screws to unroll tyvex covering. a)Lakeview Plaza Shopping Center - Employee was operating a JLG scissor lift, Model CM2033, S/N 020011487, which had been modified by the employer without prior manufacturers' written approval. The modification caused operational and driving hazards for the employee using the lift. Among feasible methods to reduce this hazard is to establish and enforce and adequate safety training program with specific training relating to the use of scissor lifts as per the Operator Manuals, ANSI A92.6-1990, Section 7.16 Modifications, and the Manufacturers Safety Manual.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Malfunctions and problems operating the JLG scissor lift, Model CM2033, S/N 0200011487, which were reported to the employer were not corrected. The employer did not stop the operation nor did he take any corrective action to protect the employee working on the scissor lift after it was reported that the lift had steering and sudden acceleration problems. a)Lakeview Plaza Shopping Center, Old A&P Building - Employee working at heights up to 15 feet above ground in a JLG scissor lift, Model CM2033, S/N 020011487, reported malfunctions and problems with the lift, steering and sudden acceleration, to the superintendent on site who took no corrective action. Among feasible methods to reduce this hazard is to establish and enforce an adequate safety training program with specific training relating to the use of scissor lifts as per ANSI A92.6-1990, Section 7.11.3, Reporting Problems or Malfunctions, which states the operator shall immediately report to the supervisor any problems or malfunctions that become evident during operation. Any problems or malfunctions that affect the safety of operations shall be repaired prior to continued use.
