Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck by falling
trees/branches while
pushing over trees with an excavator:
(A)Job Site: On 31 July 1999, an employee was felling trees by pushing them
over with a John Deere tracked excavator. This process resulted in the
employee's death when a falling branch struck the cab crushing it down on
the
employee.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS TO:
Follow the recommended safe work practices as  outlined in American
National
Standards Institute Z133.1-1988, section 8.5 Felling. This standard is
endorsed and
utilized by the International Society of Arboriculture - Pacific Northwest
Chapter.
Note: Abatement certification and supporting documentation are required
for this item.
