North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)facility, the job-made jig (below-the-hook lifting device) used by employees to lift Reading utility bodies was not manufactured, installed, inspection and maintained in accordance with good engineering practices. 1)The rated load of the lifting device was not marked on the main structure. 2)Frequent and/or periodic inspections were not conducted on the spreader bars, chains and hooks. Feasible and acceptable methods to correct this hazard includes, but are not limited to: 1.Install, inspect and maintain a manufacturer lifting device designed to lift utility bodies. 2.Have the job-made jig (lifting device) load rated, inspected, and maintained in accordance the recommendations of a Registered Professional Engineer (RPE). 3.Load rate, inspect and maintain the jig, (lifting device) in accordance with American National Standards Institute B30.20 - 1985 Below-the-Hook Lifting Devices. a.The rated load of the lifting device shall be marked on the main structure where it is visible. If the lifting device is made up of several lifters, each detachable from the group, these lifters shall also be marked with their individual rated loads Reference ANSI B30.20 - 1985, Section 20-1.2.1(a)!. b.A nameplate or other permanent marking shall be affixed displaying the following information: (1) manufacturer's name, (2) serial number, (3) lifter weight, if over 100 pounds (45 kilograms), (4) rated load Reference ANSI B30.20-1985, Section 20-1.2.1(b)!. c.Conduct frequent and periodic inspections in accordance with Section 20-1.3.2 and 20-1.3.3 of ANSI B30.20 - 1985. d.Institute a preventative maintenance program in accordance with ANSI B30.20 - 1985, Section 20-1.5.
