Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by tipping industrial trucks: a)Throughout the facility, On or about 7/11/00, Employees were operating a Tow Motor Company forklift that was not equipped with a seat belt. Employees exposed to struck by hazards. ABATEMENT NOTES: Among other methods, one feasible and acceptable method to correct this hazard is to obtain and install the available retrofit kit from the manufacturer. Then ensure that employees are using the seatbelts once installed as required by ASME B56.1- 1993 Chapter 5.3.19. Abatement documentation must be submitted for this item.
