Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by falling pipe.
On or about June 3, 1999, while off-loading 20 foot water pipe from a 45
foot flatbed trailer,
at the job site at S.W. 48th and Emma Creek Rd., employees were exposed to
possible falling
pipe.  The employer did not have adequate procedures addressing
recognition of unsafe loads,
off-loading procdures, and precautions to take for persons who may be in,
near, or enter into
the offloading area.
MOA:  Among other methods, one feasible and acceptable abatement method to
correct this
hazard is:
1.  First inspect all loads to ensure they are stable and safe and;
2.  no off-loading should be done until the forklift operator is sure that
all non-essential
persons are out of the off-loading area, and maintain constant attention
to assure persons don't
enter into the off loading area and;
3.  use spotters when handling long or oversized material to avoid hitting
any portion of
the material being off-loaded.
29 CFR 1903.19(c)(1) requires certification that the abatement of the
above violation is
complete.
