Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to hazard of falling from a raised pallet:
LOCATION:  885 Bolton Ave.,  Bronx, NY
a) On or about 3/14/01, Bolton Ave.
Two employees were lifting brick onto the sidewalk shed. The employee was
working from a
wooden pallet that was not secured or fastened to the lifting forks of the
Clark forklift, serial
number 07876872.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THE HAZARD IS:
1) Follow the safety procedures in ANSI B56.1-1975 section 427 A-D and 513
A-B by providing
fall protection and securing the work platform (wooden pallet) to the
lifting forks before it is
elevated.
