North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to: a fall or struck by hazard.
a)maintenance site- employee was operating a Kawaski Mule,
Model 2520 to transport tools and materials to the work
site and was not following the Manufacturers Owner's
Manual for safe operation.  Employee was operating a
machine that did not have a functioning parking brake,
therefore employee could not engage the parking brake,
prior to starting the engine and when dismounting the
machine when parked. Ref. to Owner's Manual, page 7,
headings (2) and (3).
b)Maintenance site-Employee was operating a John Deere
"Gator" to transport tools and materials to the work site
and was not following the Manufacturers manual for safe
operation.  Employee was operating a machine that did not
have a properly functioning parking brake, therefore the
employee could not engage the parking brake prior to
starting the engine and before dismounting the machine
when parked.  Ref. to Manufacturers Manual, page 05-3,
headings  (1) and (3).
One feasible and acceptable abatement to correct the hazard
would be to repair the parking brake.
