were causing or likely to cause death or serious physical harm to

were exposed to the hazard of serious injury as a result of entrapment of
the operator's head
and/or torso between the forktruck and the ground in the event of a
tipover:
a)On or about 11/15/00, an employee was operating a Hyster forktruck (Model
E50XL-27 Serial number C108V17689N), which was equipped with seatbelts, but
was not wearing protective restraint devices (seatbelts). The forktruck
was used
to load boxes of abrasive material onto Machine 17.
b)On or about 11/15/00, an employee was operating a Hyster forktruck (Model
S50XL Serial number A187V13014K), which was equipped with seatbelts, but
was not wearing protective restraint devices (seatbelts). The forktruck
was used
to move rolls of fabric material in the Material Storage area.
c)On or about 11/15/00, employees operating forktrucks of various
manufacture,
which were equipped with seatbelts, were not wearing protective restraint
devices
(seatbelts). The forktrucks were driven in the vicinity of open-sided
docks and
were used to enter truck bodies while moving freight
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE
ABATEMENT METHOD TO CORRECT THIS HAZARD IS ESTABLISH A
PROGRAM WHICH REQUIRES OPERATORS TO WEAR THE SEATBELTS
THAT ARE PROVIDED, AS REFERENCED IN ASME B56.1-1993 "SAFETY
STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS" AND OSHA'S
NEW POWERED INDUSTRIAL TRUCK OPERATOR TRAINING
STANDARD
