Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
Wolf Landscape Design - The employer did not furnish employment and a
place of
employment which was free from recognized hazards that were causing or
likely to cause
death or serious physical harm to employees in that, employees were
exposed to crushing
injuries due to improper maintenance, lack of seatbelt and rollover
protective structure
on the Massey Ferguson front wheel drive loader.  Interviews and
observations indicated
that the loader was not equipped with a seatbelt nor a rollover protective
structure.
Among other methods, feasible and acceptable methods to control the hazard
would be
to:
1. Equip the loader with a rollover protective structure and seatbelt.
2. Institute a company work rule effectively communicated to all employees
regarding the use of seatbelts when operating the loader and a graduated
system
of enforcement to ensure that the employees use the seatbelt.
3. Develop written procedures for inspections, operation, and maintenance
of the
loader. Training should include classroom and driving training.  Some
inspection
procedures could include functional seatbelts, fluid levels, tire
conditions.
4. Document maintenance that is performed on the loader.
Abatement certification and abatement documentation is required for this
violation. The
documentation should include written verification of abatement, applicable
measurements
or monitoring results, and photographs or videos which you believe will be
helpful. The
abatement certification sheet is enclosed with the citations.
Or in the alternative, 29 CFR 1910.132(a):
1000 East "G" Street, Ogallala - Employees were exposed to crushing
injuries
while not
wearing seatbelts while operating the Massey Ferguson front wheel drive
loader.
