Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a.On or about September 12, 2000 at the job site located at 400 Bryant
Avenue,
Bryant, Arkansas, an employee drove the CAT Model 416C tractor with back
hoe
and front end loader attachments through the building to the yard without
wearing
the seat belt.  The employee was exposed to the hazard of being struck by
the
tractor if he were ejected from the seat or struck by the roll over
protective
structure or other parts of the tractor if the tractor turned over.
b.On or about September 12, 2000 at the job site located at 400 Bryant
Avenue,
Bryant, Arkansas, an employee drove the CAT Model 416C tractor with back
hoe
and front end loader attachments across the yard without wearing the seat
belt.
The employee was exposed to the hazard of being struck by the tractor if
he were
ejected from the seat or struck by the roll over protective structure or
other parts
of the tractor if the tractor turned over.
Feasible abatement methods could include but are not limited to:
1.Wear the seat belt provided on the tractor.
