Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employee(s) using the hand operated elevator located at the work place were exposed to fall and crushing hazards from the elevator not being inspected and maintained in accordance with the American Society of Mechanical Engineers ASME A17.1 - 1996. The hand elevator was not inspected and/or maintained as follows: (a)The elevator inspection had exceeded the six month interval. (b)The opposite side of the elevator car not used for entrance was not enclosed. (c)Deficiencies noted in the elevator inspection dated October 10, 2000 were not corrected such as the following: (1)The elevator car gate needed a chain and hook. (2)The hoist cable had broken strands above the counter weights and no way to determine the condition of the counterweight connection cable. (3)The hand operated elevator needed gates to prevent employee(s) from entering the car landing areas. Among other methods, one feasible and acceptable abatement method to correct this hazards is: 1)Inspect the hand elevator at intervals of longer than 6 months as required by ASME A17.1, Rule 1010.3 2)Enclose the side of the elevator car not used for entrance as required by ASME A17.1 - 1996, Rule 601.1. 3)Correcting all deficiencies noted in the inspection report per the requirements of ASME A17.1 - 1996 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is completed..on
