Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falls in excess of ten feet above the ground.
(a) Location - 355 Garfield Road, Concord, MA:
On or about 12/19/2000, an employee was exposed to a fall hazard in excess
of ten feet
above the ground, and was not using fall protection.  According to the
ANSI standard
Z133.1.1979, 8.1.1 which reads: A tree worker shall be tied in with an
approved type
of climbing rope and safety saddle when working above the ground.  The
climbing rope
shall always be used even when work is performed from a ladder or
scaffold.  A safety
strap or rope with snaps may be used for additional protection.
AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE MEANS OF
ABATEMENT WOULD BE TO FOLLOW THE ANSI STANDARD Z133.1.1979, AND
ALWAYS WEAR AND SECURE FALL PROTECTION WHILE PERFORMING WORK IN
TREES ABOVE THE GROUND.
