Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck or crushed by a falling vehicle: (a) Location - Outside of Shop: On or about 12/27/00, an employee was exposed to being struck or crushed by a vehicle falling from a job-made rack, consisting of two separate, independent welded iron supports. Among other means, one feasible means of abatement would be to: 1. Perform an engineering review to determine the load rating of the racks to ensure they will hold the maximum expected weight of the vehicles to be placed on them. 2. Provide a way to positively lock the front and rear rack at the appropriate distance to support a car at the proper location on the frame to prevent the car from slipping off the frame.ng
