Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing and fall injuries.
At the site, employees were exposed to multiple and or death created by
the use of a
hydraulic excavator bucket being used as a work platform which was not
designed, constructed,
and/or used in accordance with the acceptable requirements of the
Construction Industry
Manufacturers Association (CIMA) for Hydraulic Excavators: Paragraph 16;
Never allow
anyone to ride the attachment or the load. This is an extremely dangerous
practice.
(a)At the site, an employee was allowed to preform demolition work from
the bucket
attachment of a hydraulic excavator while suspended approximately 30 feet
above the Christy
River.
Among other methods, feasible and acceptable methods to correct this
hazard:  Use an approved
crane suspended personnel platform meeting 1926.550(g) or other
alternative measures.
No Abatement Certification or Abatement Documentation required.
