Title 40.1-51.1(a), Code of Virginia: The employer did not furnish employment and a place of employment which were free from the recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a) At this site (Logan Roadhouse, Lynchburg, VA), Equality Construction Company failed to ensure that a full body harness with lanyard attached the basket or fork lift was worn by employees working from the basket. Two employees were observed working from the basket without wearing personal fall arrest systems. The employees were exposed to a fall of approximately 8.5 feet. "One feasible and acceptable abatement method, among others, to correct this hazard is to make sure employees wear their personal fall arrest systems while working from the elevated basket."
