Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were exposed to falling off of a moving vehicle. a) Employee was riding on the fender well of a trailer attached to moving pickup truck. b) Employee was riding on the rear bumper/step of moving van/truck. Among feasible means of abatement would be to ride in the cab of the vehicles or provide secured platform with guardrails in the back of the vehicles for employees to ride in. NO CERTIFICATION REQUIRED FOR THIS ITEM
