General-duty citation text

NYSLL Article 2, Section 27-a.3.a(1):  The employer did not furnish to
each of it's employees,
employment and a place of employment which was free from recognized
hazards that are causing
or were likely to cause death or serious physical harm to it's employees
and which will provide
reasonable and adequate protection to the lives, safety or health of it's
employees.  In applying
this paragraph, fundamental distinctions between private and public
employment have been
recognized.
a)Employees rode on the exterior riding step of two Town owned packer
trucks, a
1992 Mack chassis with a 2000 Leach Model 2R11 packer and a 1971 Mack
chassis with a 1984 Heil packer, without effective training or adequate
policy and
procedure concerning this practice thereby exposing the employees to the
hazard
of falling from the vehicle while in motion.  Further, employees were
allowed to
ride on the exterior riding steps while the vehicles were operating in
reverse
gear
which exposed them to the hazard of falling from and being run over by the
vehicle they were riding.
Reasonable and adequate abatement methods may include but
would not be limited to:
1.) Developing written safety procedures for the riding
and operation of packer trucks according to ANSI
Z245.1 1992 and the operator's manuals for the
equipment.
2.)Developing written safety procedures for refuse
collection according to ANSI Z245.1 1992.
3.)Providing a training and education program for
employees prior to assigning work on collection
routes and to routinely reinforce the training so that
employees remain familiar with the hazards they
face and the work practices that are utilized to
minimize their exposures to the hazards.
4.)Audit/supervise the workforce to determine level of
compliance with established procedures.
5.)Enforce safety procedures with appropriate
disciplinary action for non-compliance and positive
re-enforcement for compliance.
b)Employees have been allowed and encouraged to ride on the cab access
steps of
Town owned equipment utilized for refuse collection.  No prohibition
existed for
riding on the access steps of two Town owned packer trucks, a 1992 Mack
chassis with a 2000 Leach Model 2R11 packer and a 1971 Mack chassis with
a1984 Heil packer, thereby exposing employees to the potential to fall
from and
be run over by the vehicle which they were riding.
Reasonable and adequate abatement methods may include but
would not be limited to:
1.)Developing written safety procedures for the riding
and operation of packer trucks according to ANSI
Z245.1 1992 and the operator's manuals for the
equipment.
2.)Developing written safety procedures for refuse
collection according to ANSI Z245.1 1992
3.)Providing a training and education program for
employees prior to assigning work on collection
routes and to routinely reinforce the training so that
employees remain familiar with the hazards they
face and the work practices that are utilized to
minimize their exposures to the hazards.
4.)Auditing/supervising the workforce to determine
level of compliance with established procedures.
5.)Enforcing safety procedures with appropriate
disciplinary action for non-compliance and positive
re-enforcement for compliance.
c)Employees have been allowed and encouraged to ride on the access steps
of Town
owned equipment utilized for refuse collection.  Employees rode on the
access
steps of 29 different Mack and Sterling chassis dump trucks thereby
exposing
them to the potential to fall from and be run over by the vehicle which
they were
riding.
Reasonable and adequate abatement methods may include but
would not be limited to:
1.)Requiring helpers to walk between stops, or ride in
the cab of the collecting vehicle, or ride in a
following vehicle.
2.)Developing written safety procedures for refuse
collection according to ANSI Z245.1 1992
3.)Providing a training and education program for
employees prior to assigning work on collectionroutes and to routinely
reinforce the training so that
employees remain familiar with the hazards they
face and the work practices that are utilized to
minimize their exposures to the hazards.
4.)Auditing/supervising the workforce to determine

5.)Enforcing safety procedures with appropriate
disciplinary action for non-compliance and positive
