Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being" struck by " passing vehicles:
a)Job Site, 186/190 Edgewood Avenue:  Three employees cutting trees were
not
protected from being struck by vehicles. in that the employer did not
ensure that
the work zone was provided with traffic signs, warning garments and
flagmen,
on or about 3/28/02.
Among other methods, one feasible and acceptable abatement method to
correct the hazard
is:
1) Follow the safety procedures for tree care operation in ANSI Z
133.1-1994 Section 4.4
Traffic control.
2) Follow the safety procedures Manual on Uniform Traffic Control Devices
(MUTCD), Part
6 , Traffic Controls For Streets, Ansi D 6.1-71
NOTE: Because abatement of this violation is already documented in the
inspection case
file, the employer need not submit certification or documentation of
abatement of this
violation as normally required by 29 CFR 1903.19.
