North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: (Ref: American Society of Mechanical Engineers (ASME) B30.16c-1996 para 16-1.1.4.b.1) a)Shop floor, Machine Area - Employer failed to affix label to electric Abell-Howe, 1 ton hoist, displaying the word WARNING or other legend designed to bring the label to the attention of an operator. Shop floor, Machine Area - Employer failed to conduct periodic inspections at least yearly to electric Abell-Howe, 1 ton hoists, that are used daily for main function of plant operations. Shop floor, Machine Area - Employer failed to conduct frequent inspections at least monthly to electric Abell-Howe, 1 ton hoists, that are used daily for main function of plant operations.
