North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)jobsite, employee was working from pallet surface without guardrails arranged on the elevated forks of a rough terrain fork lift and was not protected by a system to minimize the hazards associated with a fall. NOTE: Among other feasible methods, one means of abatement is the use of a personal platfroms with railings and complete flooring, designed and used in accordance with ASME/ANSI 56.6.
