North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a)jobsite, employee working from a wooden pallet
raised by a rough terrain forklift.  The
employer did not take measures to protect
employees from being exposed to a 19'7" fall
hazard and did not ensure that the platform
was properly designed and constructed.
NOTE:Among other methods, one feasible and
acceptable method to abate this hazard is to:
1- Construct a platform in accordance with
ANSI B56.6 and ANSI B56.1.
2-  Equip employees with fall protection
systems as outlined in 29 CFR 1926
Subpart M Fall Protection.
3-  Work from an aerial lift with fall
protection systems meeting the
requirements of 29 CFR 1926 Subpart M
Fall Protection.
