North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)to being crushed under the frame of the 2050 lb, Clark forklift, s/n TM 127- 0039-55401, in the event the forklift was upset. The forklift was not equipped with seat belts at the operator's station which exposed the operator to being trapped between the vehicle's frame and the ground in the event the vehicle was upset during operation. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to install seat belts on the forklift and require the operator to wear them while operating the forklift.
