Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were required to enter a confined space without assurance that the space was free of flammable, toxic contaminants and oxygen deficiency: Worksite located at intersection of Maple Ln. & Shadywood, DeSoto, TX 75115: On or about June 3, 2003, at least four employees were working in trench. Employees were required to enter into an existing pipe (36-inch diameter) to work inside the pipe. Entry(ies) made into the 36-inch diameter water pipeline, for the purpose of construction of the pipeline, without assuring acceptable atmospheric conditions for all periods of entry; providing appropriate respiratory and retrieval equipment in the event of an emergency; and assuring a common communication system for monitoring the need for emergency rescue. Among other methods, recognized and feasible means of abatement to correct this hazard include, but are not limited to: Full implementation of the elements required by the American National Standards Institute (ANSI) standard Z117.1 (Safety Requirements for Confined Spaces)
