Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to the hazards of being crushed by the crane when it tipped over due to the outrigger being set over the septic tank which was unable to support its weight. A feasible and useful method to correct this hazard, among other methods, is to determine the exact location of septic systems on property by reviewing an as built or by receiving the specific location by the property owner. Location - 21 Elmer Street: The employee was exposed to the hazards of being struck by the crane when it tipped over during the tree removal process.
