North Carolina General Statute 95-129(1) of the Occupational
Safety and Health Act of North Carolina:  The employer did not
furnish to each of his employees conditions of employment and a
place of employment which were free from recognized hazards that
were causing or likely to cause death or serious physical harm to
employees:
a)pigment area, the supporting structure was not
evaluated, including trolleys, monorail, or crane, if
any, to determine that the loads and forces could be
supported by the hoist; Reference 16-1.3.2 ANSI B30.16-
1981 overhead hoists.
b)pigment area, a suspended load was left unattended and
specified precautions had not been instituted and were
not in place; Reference 16-.3.1.4(a) ANSI B30.16-1981
overhead hoists.
c)pigment area, an inspection was not conducted by an
appointed person who makes records of apparent external
conditions to provide the basis for a continuing
evaluation. An external coded mark on the hoist is an
acceptable identification in lieu of records. Normal
service - equipment in place; yearly; Reference 16-
2.1.1(b)(2)(a) overhead hoists.
Among other methods, one feasible and acceptable method to
correct this hazard would be to establish an inspection process
that incorporates these requirements as well as any other
recognized industry standards relating to overhead hoists.d
