Title 40.1-51.1.(a), Code of Virginia:  The employer did not furnish
employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in
that:
On the west side of the jobsite, the 35 approximately 3/4 inch diameter 28
inch high steel form stakes, being used in
concrete sidewalk/curb forming operations, had mushroomed heads exposing
employees to the hazard of being struck
by flying pieces  of metal.
"ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT
THESE
HAZARDS IS TO IMPLEMENT AN INSPECTION AND MAINTENANCE PROGRAM TO ENSURE
THAT THE
HEADS ARE GROUND OR CUT OFF BEFORE THEY BECOME MUSHROOMED.
