General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to the hazard of oncoming vehicular traffic: (a) On February 10, 2003, employees were exposed to the hazard of being struck by oncoming vehicular traffic while working in and around mile marker one on Hwy 89, North of Hwy 21, Oak Hill, AL. A tree had fallen onto a powerline and was laying on a powerline across the road. The victim and several other employees were attempting to clear the tree from the roadway when a log truck loaded with logs lost control of his truck when his brakes locked up. The truck slid down an embankment and rolled over onto and/or striking the employee victim. The employer did not ensure that the a work zone was not erected to alert oncomming vehicular traffic. Among other methods, recognized and feasible means of abatement to correct this hazard include, but are not limited to: Full implementation of the applicable elements required by the Manual on Uniform Traffic Control Devices (MUTCD), Part-6, Temporary Traffic Control, December 2001 edition.
