Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to:
(a) Road 5005 in the Garden Creek Timber sale: The hazard of being struck
by falling trees
which were being used for yarder guyline anchors.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to prohibit the use of standing trees for yarder guyline anchors as
stated in the Rules
Related to Logging and Logging Operations in Montana published by the
Depatment of
Labor and Industry Bureau of Safety & Health and The Montana Logging
Association,
Section 3, D on Anchoring Guylines.
