Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employee(s)
were exposed to the hazard of being struck by the wheels of a backhoe:
(a)  Alton Street, Tuskegee, AL: An employee was riding on the side of a
CAT backhoe
without the use of a seat or seatbelt and was exposed to struck by hazards
while
transporting backfill to manhole #7.
Among others, one feasible and acceptable method to correct this hazard is
to prohibit employees
from riding on the side of the backhoe without the use of a seat or
seatbelt as recommended in
the manufacturers operating manual.ng
