Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment free
from recognized
hazards that were causing, or likely to cause, death or serious physical
harm to employees.  On
October 13, 2003 a worker was fatally injured while attempting to remove
the counterweight
from the backend of a Toyo Umpanki powered industrial truck.  The worker
was situated
underneath the load when it fell, pinning the individual between the
counterweight and the
ground.
Among other means, some feasible and acceptable abatement methods to
correct this hazard are:
1.Develop, document, and utilize adequate procedural steps for securing the
counterweight during its removal process.
2.Provide training to ensure that the knowledge and skills required for
the safe
removal of the counterweight are understood by those involved and affected
by
this process.
