Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to the hazard of being struck
by trusses:
a)  On or about 1/29/03,  and at times prior, the employer did not ensure
that
employees were protected from the hazard of being struck by trusses that
are
displaced by the roller conveyor. Trusses, sagging under their own weight,
strike the
rollers of the roller conveyor, either deflecting upwards, or dive under
the roller,
putting them under spring tension. On 11/30/03 an employee was struck when
a truss
struck a roller and deflected upwards, striking the employee on head.
Abatement Note: Feasible means of abatement include, but are not limited
to, the
installation of additional rollers to minimize the downward sag of the
trusses as they come
out of the roller press. In addition, the existing rollers should be
maintained more frequently
as several of the supports were out of plumb and damaged as a result of
the aforementioned
condition.
