Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees in that an employee was exposed to struck by hazards: (a)Deton Inc. dba Slaton Brothers Inc., at the end of Miller Ranch Road and Cemetery Bridge, Edwards, CO 81632: On August 25, 2003 an employee used the Ingersoll-Rand SD- 400 serial number 152349 to compact soil without training in that the employee operated the compactor on an inclined surface which caused the compactor to turn over and exposed the employee to the hazard of being struck by the roll over protective structure as he jumped from the compactor. (b)Deton Inc. dba Slaton Brothers Inc., at the end of Miller Ranch Road and Cemetery Bridge, Edwards, CO 81632: On August 25, 2003 an employee used the Ingersoll-Rand SD- 400 serial number 152349 to compact soil without training in procedures to follow in event of a rollover in that the employee was exposed to the hazard of rollover and being struck by the roll over protective structure as he jumped from the compactor. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to train the employees who operate the compactor on its safe use according to the information provided in the Operation & Maintenance Manual provided with the machine. Training should include but are not limited to: (a)Safety Check prior to starting the machine; (b)Operating controls and instruments; (c)Start-up procedures; (d)Warning labels, their location and meaning; (e)Compactor operation; (f)Shut-down procedures; (g)Towing to include transporting and hauling. Abatement Note: Abatement certification and documentation is required for this item (See enclosed "Sample Abatement-Certification Letter").-Certification
