Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of riding in/on a motorized vehicle without seats: (a)On 25 JUN 03, passengers were allowed to ride in the cab of a John Deere 544 H front-end loader and on the ladder of the front-end loader. No seats or safe location were provided for these individuals. Note: Abatement certification and supporting documentation are required for this item. Additional Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that both drivers and workers are instructed that they are not allowed to ride on motorized equipment that does not have a seat for each occupant.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of riding in a motorized vehicle without wearing seatbelts: (a)On 25 JUN 03, passengers were allowed to ride in the cab of a John Deere 544 H front-end loader and on the ladder of the front-end loader. No seatbelts were provided for these individuals. (b)On 26 JUL 03, a driver of a pickup truck driving at the dairy did not utilized his seatbelt. (c)On 27 JUL 03, the operator of a Ford 3415 tractor was not wearing his seatbelt while driving the tractor. Note: Abatement certification and supporting documentation are required for this item. Additional Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that both drivers and workers are instructed that is not equipped with a seatbelt for each occupant.
