A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that the employer did not ensure that all powered industrial trucks were equipped with operator restraint devices, including seat belts, to be used during the operation of such trucks in accordance with the American National Standards Institute (ANSI) B56.1, consensus Safety Standards for Low Lift and High Lift Industrial Trucks, to protect the operator in the event of a rollover: a) Yard: The employer did not enforce the wearing of an operator restraint device (i.e., seat belt) intended to protect the operator of a Toyota Forklift, Model 023FG35, serial number FC35-10483, in the event of a rollover.
